Zumpolle Firm of lawyers is a partnership of lawyers, hereinafter also referred to as 'the partnership'. These general terms and conditions applicable to each agreement or other legal relationship between the partnership and another party, hereinafter also referred to as 'the client', under which the partnership performs or will perform work.

Agreements or legal relationships with clients which come into being via the lawyers or via employees of the partnership are deemed to have come into being solely with the partnership.

The legal relationship between the client on the one side and the partnership on the other is subject exclusively to the Netherlands law.

Payment of invoices must take place within 14 days of the invoice date. If an invoice is not paid within 14 days, the client will be in default ipso jure, and will also owe interest of 1% per month.

In the event that no payment is forthcoming, as a result of which collection measures must be taken, the client will also owe 15% extrajudicial collection costs.

The partnership will exercise due care when engaging third parties who are not part of the partnership. No liability is accepted for shortcomings of such third parties.

Each liability of the partnership and/or of the lawyers and/or of employees of the partnership for damage/loss arising from or related to an attributable shortcoming or wrongful act, or which is based on any other legal ground, is limited to the amount which is paid out in the case in question under the professional liability insurance, plus the excess under the insurance in question.

If the insurance company does not pay out in any given case, liability for the total damage/loss arising from or related to the agreed work is limited to the amount paid by the client to the partnership for the work in relation to which the damage/loss occurred. The client is only entitled to claim this limited amount from the partnership.
